Terms for teachers, pilots, and school partners.

These terms govern your use of DetermiNext. Campus and district customers also require a signed Data Processing Agreement before going live.

Parties and scope

These Terms of Service are between DetermiNext (operated under Serbesa Software LLC, a Nevada limited liability company) and the teacher, school, or district ("Customer") accessing the service. Students are end users of the service, not parties to these terms. These terms are effective as of May 16, 2026.

Account responsibilities

Teachers and school administrators are responsible for: maintaining accurate student roster information; controlling which students receive assessment access; reviewing all AI-generated transition planning output before use in official records, IEPs, or student meetings; and keeping account credentials secure and not sharing them.

FERPA obligations on the school side

The Customer warrants that it has legal authority to share student education records with DetermiNext for the purpose of providing the assessment service, and will only enrol students for whom it has appropriate authority under FERPA. Individual teacher trial accounts are governed by the Privacy Policy and these Terms. Campus and district accounts require a signed Data Processing Agreement before going live.

AI output responsibility

DetermiNext generates transition planning reports using AI. These reports are assistive tools designed to support — not replace — professional educator judgment. Teachers and schools bear full responsibility for any use of AI-generated content in official student records, IEPs, or student meetings. Serbesa Software LLC makes no warranty as to the accuracy, completeness, or fitness of AI output for any specific student or educational purpose.

Acceptable use

Customers must not: attempt to bypass access controls, scrape, probe, or overload the service; upload unlawful content or content that violates student privacy; share student data outside the intended classroom workflow; use DetermiNext in a way that violates FERPA, applicable state law, or the school's own data governance policies; or share account access credentials with unauthorised individuals.

Billing and subscription

Individual teacher plans are available via self-serve checkout processed by Stripe. Campus and district plans are quote-based and governed by a separate order form, invoice, or agreement. Student data is never shared with Stripe; only teacher and school billing contact information is processed by Stripe.

Free trial. Individual teacher accounts include a 30-day free trial. No payment method is required to start a trial. The trial ends automatically — it does not convert to a paid subscription without your action.

Educator Pro plans. After the trial, individual teachers may subscribe to an Educator Pro monthly or annual plan. Current pricing is published at determinext.com/pricing. Annual plans are billed as a single payment covering 12 months.

Auto-renewal. Monthly subscriptions renew every 30 days. Annual subscriptions renew on the billing anniversary. Renewal is charged automatically to the payment method on file via Stripe. You will receive a renewal reminder by email before each charge.

Cancellation. You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of your current billing period — your access continues until then. No further charges are made after cancellation.

Refunds. Payments already processed are non-refundable. Cancellation stops future renewals but does not entitle you to a refund for the current billing period.

Price changes. If Serbesa Software LLC changes the price of an Educator Pro plan, you will be notified by email at least 30 days before the change takes effect. Continued use after the notice period constitutes acceptance of the new price.

Suspension and termination

Serbesa Software LLC may suspend or terminate accounts for misuse or violation of acceptable use terms, non-payment after reasonable notice, or inactivity beyond the agreed trial or subscription period. Upon termination, student data is retained for 90 days then permanently deleted per the Privacy Policy and any applicable Data Processing Agreement.

Limitation of liability

Serbesa Software LLC's total liability under these terms is limited to fees paid in the prior 12 months. Serbesa Software LLC is not liable for indirect, incidental, special, or consequential damages, including loss of data, even if advised of the possibility of such damages.

Governing law

These terms are governed by the laws of the State of Nevada. Any disputes shall be resolved in Clark County, Nevada.

Changes to terms

Serbesa Software LLC may update these terms. For material changes, 30 days' notice will be provided via the email address on file. Continued use after the notice period constitutes acceptance of the updated terms.
